Terms & Conditions

Please read carefully before placing an order with SwiftPath Logistics.

⚠️ IMPORTANT — PLEASE READ CAREFULLY

By placing an order, making a payment, or using any service offered by SwiftPath Logistics Limited, you confirm that you have read, understood, and agreed to be bound by these Terms and Conditions in full.

1. Definitions

In these Terms and Conditions, the following definitions apply:

  • SwiftPath / Company / We / Us — SwiftPath Logistics Limited, its agents, staff and representatives
  • Client / You — Any individual or business that engages SwiftPath Logistics for any service
  • Goods / Shipment — Any item, parcel, package or consignment handled by SwiftPath on behalf of a Client
  • SA Address Service — The service where a Client ships goods to SwiftPath's South Africa address for onward delivery to Zambia
  • Sourcing Service — The service where SwiftPath purchases goods on behalf of a Client from South African stores or suppliers
  • Provisional Invoice — An initial invoice issued before goods arrive at the border or destination, subject to revision
  • Final Invoice — The confirmed invoice issued upon arrival of goods at the border or in Lusaka, reflecting actual charges
  • Customs Duty — Taxes and levies imposed by the Zambia Revenue Authority (ZRA) on imported goods
  • Volumetric Weight — A calculated weight based on the size/dimensions of a package, used when it exceeds actual weight
  • Force Majeure — Events beyond the reasonable control of SwiftPath including customs delays, border closures, strikes, natural disasters, or government actions

2. Our Services

SwiftPath Logistics Limited offers the following services between South Africa and Zambia:

2.1 — SA Address Service (Use Our Address)

  • SwiftPath provides Clients with a South Africa shipping address to use when placing orders on Takealot, Shein, Temu, or any SA retailer or supplier.
  • Once goods are received at our SA address, they are consolidated, packaged and transported to Zambia.
  • The Client must notify SwiftPath immediately after placing an order and complete the SwiftPath Order Form.
  • SwiftPath is not responsible for goods ordered but not declared by the Client on the Order Form.

2.2 — Buy on My Behalf (Sourcing Service)

  • SwiftPath sources, purchases and delivers goods on behalf of Clients from SA stores, suppliers, or online platforms.
  • The Client provides product details, links, photos or descriptions. SwiftPath confirms availability and pricing before purchase.
  • Goods are only purchased after the Client confirms the quoted price and payment is received.
  • SwiftPath will provide the Client with purchase receipts for all goods bought on their behalf.

2.3 — Collection and Inspection Services

  • SwiftPath can collect goods from a physical store or supplier on behalf of the Client, subject to a collection fee.
  • Pre-purchase inspection of goods can be arranged at an additional fee where practically possible.

3. Orders, Invoices and Payment

3.1 — Placing an Order

  • All orders must be submitted via the official SwiftPath Order Form at zed.swift-bw.com or as provided by SwiftPath staff.
  • An order is only confirmed once SwiftPath has issued an invoice and payment has been received.

3.2 — Provisional and Final Invoices ⚠️

The invoice issued at the time of booking is a PROVISIONAL invoice only. Once goods arrive at the Zambia border or in Lusaka, a FINAL invoice will be issued reflecting actual charges.

  • The Provisional Invoice is an estimate based on information available at the time of booking.
  • The Final Invoice reflects actual charges including any customs duties, revised weight charges, or additional fees incurred.
  • The Client is obligated to pay the Final Invoice in full before goods are released for delivery or collection.
  • Any difference between the Provisional and Final invoice — whether higher or lower — must be settled or refunded accordingly.

3.3 — Payment Terms

  • All payments must be made in full before goods are dispatched from South Africa, unless otherwise agreed in writing.
  • Accepted payment methods: Bank Transfer, MTN Mobile Money (MoMo), or any method confirmed by SwiftPath in writing.
  • Proof of payment must be sent to SwiftPath via WhatsApp or email immediately after payment.
  • Goods will NOT be dispatched, released or delivered until full payment has been confirmed.
  • SwiftPath reserves the right to hold goods in storage if payment is not received within the agreed timeframe. Storage fees will apply.

4. Weight, Volumetric Weight and Pricing

All shipping charges are calculated based on the GREATER of the actual weight or the volumetric (dimensional) weight of the shipment. This is standard practice across the international logistics industry.

Understanding Volumetric Weight

Volumetric weight accounts for the space a package occupies during transport, regardless of how light it may be. A large but lightweight package takes up the same space as a heavy one and is charged accordingly.

📦 Example:

A box measuring 60cm × 40cm × 30cm weighs only 2kg on the scale.
Volumetric weight = (60 × 40 × 30) ÷ 5,000 = 14.4kg
Since 14.4kg > 2kg, the shipment is charged at 14.4kg.

Common examples charged by volumetric weight: large clothing bundles, foam mattresses, empty luggage, bulky electronics packaging, gym equipment, flat-pack furniture.

  • SwiftPath will inform the Client of the chargeable weight as soon as goods are received and weighed at our SA facility.
  • If the chargeable weight differs significantly from the Client's estimate, a revised invoice will be issued before dispatch.
  • Quoted prices are valid at the time of the quote only and may change due to exchange rate fluctuations or carrier rate changes.

5. Customs Duties and Border Clearance

5.1 — Client Responsibility

  • All applicable customs duties, taxes, and import levies imposed by the Zambia Revenue Authority (ZRA) are the sole responsibility of the Client.
  • SwiftPath does not absorb, subsidise or guarantee any customs duty amounts. Duty rates are set by government and beyond SwiftPath's control.
  • Not all goods attract customs duty. Whether duties apply depends on the type of goods, their declared value, and applicable ZRA regulations at the time of importation.

5.2 — Providing an Invoice for Customs

The Client MUST provide a valid commercial invoice or store receipt for all goods being imported. If the Client fails to provide a valid invoice, SwiftPath will use its own means to determine the value of goods for customs purposes. The Client accepts full responsibility for any additional duties, penalties or delays arising from missing documentation.

  • SwiftPath reserves the right to recover all customs-related costs, including penalties incurred due to incorrect or missing documentation provided by the Client.

5.3 — Customs Assistance

  • Where requested and agreed in advance, SwiftPath can assist the Client in paying customs duties on their behalf. This amount will be added to the Final Invoice and must be reimbursed in full.
  • SwiftPath is not a licensed customs clearing agent. Clearance assistance is provided as a convenience service.
  • SwiftPath is not liable for goods seized or confiscated by customs authorities due to prohibited items, incorrect declarations, or regulatory non-compliance.

6. Refund Policy

6.1 — Refund Processing Timeline ⚠️

Payments made to SwiftPath Zambia are immediately processed and transferred to South Africa to cover procurement, logistics and operational costs. Refunds therefore require time to be recalled and returned.

  • A refund request must be submitted using the official SwiftPath Refund Request Form.
  • Once a Refund Request Form has been submitted and approved, refunds will be processed within a minimum of 1 (one) business day and a maximum of 30 (thirty) calendar days.
  • The Client will be notified once the refund has been processed and provided with proof of payment.
  • Refunds are processed using the current prevailing exchange rate at the time of processing, not the rate at the time of the original payment.

6.2 — Non-Refundable Circumstances

  • Goods already purchased on the Client's behalf under the Sourcing Service are non-refundable once the purchase has been made.
  • Transport fees, collection fees, and inspection fees are non-refundable once the service has been rendered.
  • Customs duties paid on behalf of the Client are non-refundable as these are government levies.
  • SwiftPath reserves the right to deduct any outstanding storage fees or costs incurred from any refund amount due to the Client.

7. Transit Times and Delivery

  • Standard transit time from South Africa to Zambia is approximately 5 (five) working days from the date goods are dispatched from the SwiftPath SA facility.
  • Transit times are estimates only and are not guaranteed. They may be affected by customs clearance, public holidays, carrier delays, weather, or other unforeseen circumstances.
  • SwiftPath will communicate updates to the Client via WhatsApp throughout the transit process.
  • Upon arrival in Zambia, the Client will be notified and given the option of delivery (subject to a delivery fee) or collection from a SwiftPath holding point.
  • Goods not collected within 14 (fourteen) days of arrival in Zambia will attract a daily storage fee.

8. Liability, Delays and Loss of Goods

8.1 — Force Majeure — Events Beyond Our Control

SwiftPath shall not be held liable for any delays, losses, damages or failures arising from events beyond its reasonable control, including but not limited to:

  • Customs holds, border closures or government-imposed restrictions
  • Strikes, civil unrest, or industrial action by third-party carriers
  • Natural disasters, floods, fires or extreme weather conditions
  • Delays caused by third-party logistics providers or courier companies
  • Changes in import/export regulations or government policies
  • Theft, damage or loss caused by third parties during transit

8.2 — SwiftPath's Liability

  • SwiftPath's liability for any loss, damage or delay is limited to the value of the transport and handling fees paid by the Client for the specific shipment affected.
  • SwiftPath is not liable for consequential losses, including loss of business, loss of income, or any other indirect loss suffered by the Client due to delays or non-delivery.
  • Clients shipping fragile or high-value items do so at their own risk unless special handling has been agreed in writing. SwiftPath does not provide cargo insurance.

8.3 — Prohibited and Restricted Goods

  • The Client is solely responsible for ensuring that goods are legal to import into Zambia.
  • SwiftPath will not knowingly handle prohibited goods including weapons, drugs, hazardous materials, counterfeit goods, or any item restricted under Zambian or South African law.
  • Perishable goods are transported at the Client's own risk. SwiftPath does not provide refrigerated or temperature-controlled transport.

9. Client Obligations

  • Provide accurate, complete and truthful information when placing orders, including correct descriptions and values of goods.
  • Declare all goods shipped to the SwiftPath SA address via the Order Form immediately upon placing the order.
  • Provide valid purchase invoices or receipts for all imported goods to assist with customs clearance.
  • Pay all invoices in full and on time as stipulated by SwiftPath.
  • Notify SwiftPath immediately of any changes to delivery address, contact details or order requirements.
  • Be available or ensure a representative is available to receive goods at the agreed delivery address.
  • Not ship prohibited, restricted, hazardous or illegal goods to the SwiftPath SA address under any circumstances.

10. Storage

  • Standard storage is included for up to 7 (seven) days after goods arrive at the SwiftPath SA facility or Zambia holding point.
  • After 7 days, a storage fee will be charged per day until the goods are dispatched, collected or delivered.
  • SwiftPath will not release goods until all outstanding invoices, including storage fees, have been paid in full.
  • If goods remain uncollected for more than 60 (sixty) days, SwiftPath reserves the right to dispose of or auction the goods to recover outstanding costs, after providing the Client with reasonable written notice.

11. Privacy and Confidentiality

  • SwiftPath collects and stores Client personal information including name, address, phone number, email and order details for the purpose of providing logistics services.
  • Client information will not be sold or shared with third parties except where necessary for the delivery of services (e.g. customs authorities, delivery partners) or as required by law.
  • Clients consent to receiving service-related communications via WhatsApp, SMS or email regarding their orders.

12. Disputes and Governing Law

  • SwiftPath encourages all Clients to raise concerns directly with our team via WhatsApp or email in the first instance.
  • In the event of a dispute that cannot be resolved amicably, the parties agree to attempt resolution through mediation before pursuing legal proceedings.
  • These Terms and Conditions are governed by the laws of the Republic of Zambia.

13. Amendments to These Terms

  • SwiftPath reserves the right to update or amend these Terms and Conditions at any time.
  • Updated Terms will be published on the SwiftPath website at zed.swift-bw.com and communicated to active Clients via WhatsApp or email.
  • Continued use of SwiftPath services after notification of changes constitutes acceptance of the revised Terms.

14. Acceptance of Terms

By engaging SwiftPath Logistics Limited for any service — whether by placing an order, making payment, or submitting an Order Form — you confirm that:

  • You have read and understood these Terms and Conditions in full.
  • You agree to be legally bound by these Terms and Conditions.
  • You accept the Refund Policy, Weight & Pricing Policy, and Customs Policy as outlined above.
